Landlords and renters

Typically, landlord and renter issues are a civil matter and do not involve law enforcement. However, I frequently have both landlords and renters come to me with questions.

I start by advising them to contact their attorney and explain that I’m unable to give legal advice. Once that is done, I can help them think through their dilemma.

For landlords, the issue almost always comes down to having a good rental agreement that clearly outlines the duties of the property owner and the duties of the renter.

This becomes extremely important should a renter fail to follow the agreement and the landlord needs to evict someone.

When an eviction occurs, I am occasionally subpoenaed to give testimony in court as to what I have seen and heard while at the rental.

This can included noise complaints, criminal acts and even the condition of the rental. Another issue with landlords is when they try to be "NICE".

I have seen landlords not follow their own agreements by extending payment deadlines, accepting partial payments of failing to act on violations.

When landlords do this, it can lead to confusion with renters as to what is and is not a violation of the rental agreement and it makes it difficult to explain in court when you verbally modify your written rental agreement.

As for renters, there are organizations in Minnesota that provide excellent information regarding renter rights.

A quick Google search will provide you with their contact information.

In addition, I give renters the following advice: Know your rental agreement and follow it.

If you live in an apartment, you need to accept the fact that the walls are thin and that you must share the space with other people.

Respect and politeness are the keys to having good relationships with your neighbors.

Apartment living is not for everyone and if you like to be loud, have parties, smoke and do other things you may want to rent a home or a farm house where you will have more freedom and privacy.
